[Help] f4-424 max fails to iniliaze

unit boots, I get the 3 beeps. I have it hooked to a monitor so I can see the startup and it listing its ip address.
unable to connect from pc or mobile device using the ip or tnas.local or whatever that address is. I've attempted both with and without any drives installed.
Attempted the tnas software for windows.
it locates the device but says ip address is not compatible with network settings and wants to change it asking for password. I enter the default password and watch on the other monitor as the system updates to this new ip address the software suggests. tnas software still sees it with the updated ip and initialization is still grayed out and it repeats wanting to change the ip address this time to yet another new address, example would be: device is currently 192.168.1.2, software will want to change it to 192.168.1.3 then after letting it it will want to change it to .4 then to .5 in an endless loop. Any attempts to manually enter an ip address result in the software not allowing me to apply it. I also tried setting a static ip via my router and still have the same thing happen.
next attempt was to try the tnas app for android. it sees the device, says its initializing then goes back to default screen. watching the monitor for the unit shows nothing after the initial handshake when the app searches for devices.
flashed a new usb drive and booted from that and still have the same issue.
hooking up a keyboard I'm able to login as root and tried to follow some older posts I've found on here for other devices.
found an older post about using wget to startup the online script but that script doesn't exist. also found an older post to download the bzimage from command line but get a wget doesn't exist error.
at one point I did see a magic number error but need to recreate my attempts to find that and look at it more closely.
any thoughts or help to figure this out would be appreciated. Its now 4am and I started at 10pm so my brain is fried. if screen shots are helpful I will attempt to take some tomorrow/today when I have more time to address this. I'm really kicking myself right now if this was a dud as I've had it sitting for nearly a year since I bought it and am just now trying to set it up.
